Terms and Conditions
Release and Assumption of Risk
By signing this document, I acknowledge that I have carefully read and fully understand its contents. I voluntarily agree to its terms and conditions, and choose to participate.
I, the driving student or Parent/Guardian of the driving student (if under 18), hereby acknowledge and agree to the following terms and conditions as a prerequisite to participating in driving lessons with St. Charles County Driving School, LLC, hereinafter referred to as SCCDS:
1. Learners Permit or Driver License: All students must have a valid learners permit or drivers license. Students must keep their permit/license with them during driving lessons. If a students permit expires, it must be renewed before additional lessons can be scheduled.
2. Vehicle: I understand lessons will take place in a vehicle owned by the student, parent or guardian. I understand the vehicle must:
- Be in a mechanically safe condition.
- Have properly working heat and air conditioning.
- Must have a clean area for the student and instructor.
- Must be free from visual obstructions for the driver.
- Must have current state license plates (RSMo 301.130) and safety sticker displayed (where required).
If an instructor deems that any of the above vehicle conditions are not met, the lesson will be cancelled without refund in accordance with the herein specified cancellation policy.
3. Insurance: I understand that it is my responsibility to provide vehicle insurance for the vehicle driven by the student during lessons, in accordance with RSMo. 303.024.
4. Payment: Payment in full is due immediately upon booking a lesson via credit or debit card. A scheduled lesson will be held for 24 hours and will only be secured upon receipt of full payment. If payment is not received within 24 hours, the scheduled lesson will be cancelled. Any future lessons will need to be paid prior to booking if a lesson is cancelled for nonpayment. I understand credit/debit cards will be charged a surcharge for processing. If other form of payment is requested, this must be approved prior to scheduling.
5. Cancellation Policy: Notification for cancellation/reschedule request must be made 7 days prior to the scheduled lesson in order to receive a full refund. Cancellation of less than 7 days, but greater than 48 hours will receive a refund minus $80.00, and less than 48 hours will receive no refund. In the case of emergencies or activity conflict (i.e. sports, extra curricular), fees may be waived with permission from the Lead Instructor. Lessons cancelled due to the instructor deeming any of the herein stipulated requirements not being met will receive no refund.
6. Refunds: Refunds will be issued via payment method used for purchase. Under no circumstances will a service fee be included in a refund. Refund requests or partial refund requests for purchases of the Lesson Bundle or Mini Bundle will be issued minus the lessons received or in accordance with the aforementioned cancellation policy. Lessons received/scheduled will be calculated at the Individual Lesson price of $150.00 each.
7. Lesson Expiration: Lessons purchased individually must be completed within 3 months from date of purchase. Lessons purchased as part of a Mini Bundle must be completed within 3 months from date of purchase. Lessons purchased as part of a Bundle Pack must be completed within 6 months from date of purchase. In the case a student is 15 years of age, and therefore is not legally eligible to take the driving exam within the 6 month period, the Parking and Test Prep lessons purchased as part of a Mini Bundle or Bundle Pack can be extended for up to 1 year from date of purchase, but must be redeemed within 30 days of the students 16th birthday.
8. Parent/Guardian/Student Responsibility: Students are required to practice driving between lessons in order to retain skills instructed, as well as to complete the numbers of hours legally required of permit holders under the age of 18 to be eligible to take the driving skills test. If an instructor determines that the student has not had adequate practice to proceed with a scheduled lessons curriculum, the instructor may modify the lesson curriculum without advance notice.
9. Safety:
- Students are required to wear any prescription glasses or contacts required to satisfy the minimum vision requirements for driving as set by 12 CSR 10-24.090 - Missouri Driver License or Permit Vision Test Guidelines.
- Students may not be under the influence of any substance, including but not limited to narcotics or alcohol, that impairs their ability to operate the vehicle safely.
- Students must wear lace up closed toe shoes (such as athletic shoes) during lessons. No slides, flip flops, crocks, or sandals of any types are to be worn, nor shall students wear shoes with a heel greater than ½ inch. Students are not to wear hats or a hood during lessons.
- The use of ear buds or any other type of ear device is to be used, other than one which is medically required for hearing assistance.
- Students may have a cell phone with them during a lesson, however the phone must be silenced and is not to be used without permission from the instructor.
10. Instructor Discretion:
Instructors reserve the right to terminate lesson with no refund issued under the following circumstances:
- Disrespectful behavior on behalf of the student in the form of profanity or offensive language.
- Student behavior is disruptive, threatening or intimidating.
- If a student intentionally places themselves, the instructor, or others in an unsafe situation or circumstances.
If the instructor deems it necessary to terminate a lesson, the instructor reserves the right to drive the students vehicle back to the students home or other location where the lesson began.
At the time a student, parent, or legal guardian requests a Test Prep to be scheduled, the instructor will determine if the student possesses the skills required for the driving skills test. If the instructor determines the student does not possess the required skills, the lesson will not be scheduled, in order for the student to have additional time to practice and further develop their driving skills.
If there is a gap of 60 days or more between lessons, or if the instructor has reason for concern regarding the students driving skills, the instructor may require the student to complete an additional 1 hour assessment, in order to evaluate the student’s current skill level, prior to scheduling the Test Prep. The purpose is to ensure the students skills have progressed to the level required for the driving skills test and to be an independent safe defensive driver. The cost of this assessment will be $75.00.
11. Inclement Weather: Instructors reserve the right to reschedule lessons due to current or imminent hazardous weather conditions which create or could potentially create unsafe road conditions. This includes but is not limited to snow, ice, heavy rain, tornado watch/warning, sleet, hail, or flooding. In the case of snow/ice, it will be a requirement for a safe walking path to be cleared for the instructor to the student’s residence and vehicle, as well as there being a safe path for the student’s vehicles to exit and enter the parking area. If there is not a safe area for the instructor or vehicle, the lesson will be cancelled with no refund in accordance with the cancellation policy.
12. Assumption of Risk: I understand and acknowledge that driving instruction involves inherent risks, including but not limited to the risk of property damage, bodily injury, or death. I voluntarily assume all such risks associated with participating in driving lessons.
13. Release of Liability: In consideration of being permitted to participate in driving lessons, I hereby release, waive, discharge, and covenant not to sue SCCDS, its instructors, employees, agents, and affiliates (collectively referred to as "Released Parties"), from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including but not limited to bodily injury, property damage, or death, that may be sustained by me, my child/family member or any third party as a result of participating in driving lessons, whether caused by the negligence of the Released Parties or otherwise.
14. Indemnification: I agree to indemnify and hold harmless the Released Parties from and against any and all claims, demands, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorney's fees) incurred by the Released Parties, arising out of or related to mine or my child/family members participation in driving lessons or any breach of this waiver.
15. Medical Authorization: In the event of any injury or medical emergency that may occur during my participation in driving lessons, I authorize SCCDS and its instructors to seek and obtain medical treatment on my behalf, including but not limited to administering first aid, calling emergency medical services, and transporting me to a medical facility, at my expense.
16. Photographic Release: I grant SCCDS the right to take photographs and/or videos of me, the student and/or the vehicle being driven by the student during driving lessons and to use such materials for promotional or educational purposes without compensation to me. I understand none of the photographs will contain personal identifying information such as name, address or license plates.
17. Binding Effect: This waiver shall be binding upon my heirs, executors, administrators, successors, and assigns, and shall be interpreted according to the laws of the State of Missouri.
18. Severability: If any provision of this waiver is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way.
Student or Parent/Legal Guardian (if student under 18): By continuing with payment for services, I acknowledge that I have carefully read and fully understand its contents. I voluntarily agree to its terms and conditions, and voluntarily choose to participate or allow my child/family member to participate.
